Policy
The Paul Mellon Centre for Studies in British Art (PMC) is committed to providing access to its published materials and activities in as open a manner as it can allow for as broad a public as it can reach. In its roles as both an educational charity and a research institute, the PMC aims to promote the awareness, study and enjoyment of British art.
The PMC fully supports the protection of intellectual property and is committed to complying with, and strictly adhering to, all applicable copyright law. In some cases, exceptions to copyright that permit limited use of protected works without the permission of the copyright owner may have been applied.
On this site, digital copies of resources are made accessible for research for one of the following reasons:
- They are in the public domain, in the sense that any copyrights have expired.
- The rights are owned by the Paul Mellon Centre for Studies in British Art.
- We make them accessible under an exception or limitation to UK copyright law. as outlined in the Copyright, Designs and Patents Act 1988 (as amended).
- We have permission from rights holders to make them accessible.
- There are no known restrictions on use.
Our Images
Images created by our staff photographers are released with a Creative Commons (CC) Creative Commons Attribution-NonCommercial 4.0 International (CC BY-NC 4.0) licence.
This licence lets you use and share images in specific contexts that respect the rights of other parties, such as the owners of the works of art our images depict.
You can use the images only if you:
- Attribute (BY) the image to the Paul Mellon Centre: After identifying the work itself, we recommend that you use a credit line such as ‘Digital image courtesy of the Paul Mellon Centre, PA-F00000-0000’ so that others may identify our record of the work.
- Use it in a non-commercial (NC) context only: The image cannot be reproduced in any manner that is primarily intended for, or directed towards, commercial advantage or monetary compensation. This does not necessarily restrict the use of the image in all commercial contexts whatsoever. For example, under certain circumstances, inclusion of the image in an academic publication would be acceptable.
All of the PMC’s CC images are labelled as such and can be searched by using the ‘Source of photograph filter. You are not required to inform us of your use of the images, but we would be interested to hear from you if you wish to do so.
Use beyond the terms of this Creative Commons licence will require further consent from the PMC.
Images Provided by Others
Photographs supplied to the collection by third parties were provided under contractual conditions restricting their onward use.
Though these images are largely straightforward facsimile copies of the underlying works of art (and therefore do not attract their own copyright), these contractual restrictions remain in effect.
A licence from RightsStatements.org of ‘No Copyright – Contractual Restrictions’ has been applied to each of these images. This means that you must contact the rights holder / owner directly to request any use beyond personal research. Where rights holders / owners are private parties, PMC can usually help facilitate contact.
Take Down Policy
We are confident that we have carried out due diligence in our use of copyright or contractually restricted material as required, but we apologise for any inadvertent infringement of rights.
As part of our assessment, we have made efforts to ascertain the rights status and identify any rights holders for every image published, and entered into consultation with those parties where necessary.
If you believe that we have made a mistake and wish for your material to be removed from our site, please contact us.
The PMC will respond promptly, normally within 21 business days. We may remove the resource from our site while we investigate. Upon completion of the assessment, we will take appropriate action and tell you what we have done.
